Terms of Service and Digital Services Provision

This Regulation determines the conditions of access and use of the website available at Rally-Clock.com, including the terms of providing digital services in a subscription model and the rules of using the information functionalities of the Service.

This Regulation is effective as of January 12, 2026

I. General Provisions

1. This Regulation determines the conditions of access and use of the website available at Rally-Clock.com (hereinafter: "Service"), including the terms of providing digital services in a subscription model and the rules of using the information functionalities of the Service.

2. The owner and administrator of the Service and service provider is: Michał Wiewiórowski, conducting business under the company name: MICHAŁ WIEWIÓROWSKI, with headquarters: ul. Brodzka 5a, 54-103 Wrocław, NIP: 8271758109, e-mail: office@rally-clock.com (hereinafter: "Owner" or "Service Provider").

3. The Regulation is made available to the User/Client free of charge prior to concluding the contract, in a manner enabling its acquisition, reproduction and preservation. Use of the Service is equivalent to accepting the Regulation.

4. All trade names, company names and their logos used on the Service belong to their owners and may be legally protected. Unauthorized use of Service content, including copying, reproduction, retransmission or other use contrary to law or this Regulation is prohibited.

II. Definitions

1) Service - an internet service available at Rally-Clock.com, being a tool for providing electronic services.

2) Owner/Service Provider - the entity indicated in Section I.2 above.

3) User/Client - a natural person, legal person or organizational unit without legal personality, to which the law grants legal capacity, using the Service or concluding a contract for the provision of a Digital Service.

4) Consumer - a natural person performing a legal action not directly related to their business or professional activity.

5) Account - a collection of resources and settings on the Service assigned to the User/Client, accessible after logging in using an individual username (login) and password.

6) Digital Service - paid access to an online application available on the Service.

7) Subscription - time-limited access to the Digital Service purchased for a period from 1 to 12 months, according to the selected plan.

8) Payment Operator - a payment service provider handling payments on the Service, i.e. HotPay.pl.

9) Terms - a set of all provisions of the Regulation and related documents (Privacy Policy, Cookies Policy and other functionality regulations, if applicable).

III. Scope of Services and Use of the Service

1. The Service Provider provides digital services consisting of ensuring access to an online application in a subscription model. Access to the Service also includes content of an informational nature and may include advertising content.

2. Access to the Service is continuous, with the exception of technical breaks necessary for the proper functioning of the Service.

3. A detailed description of the Service functionality and current prices are available on the Service.

4. The User may use the Service solely in accordance with applicable law and the provisions of this Regulation; provision of illegal content, sending spam, and transmission of malicious software is prohibited.

IV. Registration and Contract Conclusion

1. Through the Service, the User can create an Account by filling in the registration form and accepting the Regulation.

2. The contract for the provision of the Digital Service is concluded when payment is effectively received via the Payment Operator, unless the Service provides otherwise.

3. Conditions for placing an order are:

  • (a) acceptance of the Regulation and Privacy Policy,
  • (b) consent to commence service provision before 14 calendar days from the conclusion of the contract,
  • (c) confirmation of loss of the right of withdrawal after activation of access to the Service.

4. After payment is received, the Client gains immediate access to the Service.

V. Payments and Subscription

1. Payments are processed through the Payment Operator (HotPay.pl) in accordance with their terms.

2. The subscription is valid for the period specified in the order. Unless the Service provides otherwise, the subscription does not automatically renew.

3. After the subscription period ends, access to the Service is blocked, unless the Client purchases another subscription period.

4. The Client has no possibility of early termination of the subscription contract for reasons on their side, unless mandatory applicable law provides otherwise.

VI. Right of Withdrawal from Contract (Consumers)

1. Services provided on the Service constitute digital content delivered immediately after purchase or - in the case of a subscription - from the time of its activation.

2. The consumer loses the right to withdraw from a distance contract if, before 14 days have elapsed, they agreed to commence service provision and were informed of the loss of this right, which they confirm during the order placement process.

3. After activation of access to the Service, refunds are not available, except as required by mandatory applicable law.

VII. Complaints

1. The Client has the right to file a complaint regarding improper operation of the Service or functionality of the Service.

2. Complaints can be submitted by e-mail to: office@rally-clock.com or another address indicated on the Service; the complaint should include the Client's details and description of the problem.

3. Complaints are processed within 14 days of receipt; the Client will be informed electronically of the outcome.

VIII. Intellectual Property

1. The Service and its content may be protected by copyright, trademark rights and other intellectual property rights.

2. Trademarks, logos and other designations of the Owner constitute legally protected marks. Their use without prior written consent of the Owner is prohibited.

IX. Personal Data Protection (GDPR)

1. The Service Provider is the administrator of personal data. Personal data is processed for the purpose of concluding and performing the contract, payment processing and fulfilling legal obligations.

2. The basis for data processing is Article 6(1)(b) and (c) GDPR. Data recipients may include, in particular, the Payment Operator, hosting providers and entities providing accounting services.

3. Personal data is retained for the duration of the contract and then for the period required by law. Providing data is voluntary but necessary to conclude the contract.

4. The data subject has the right to access data, rectify it, erase it, restrict processing, transfer data and lodge a complaint with the GDPR authority.

X. Cookies and Privacy

1. The Service uses cookies or similar technologies to ensure proper functioning, gather statistics and adapt content to User preferences.

2. Some cookies are session-based and expire after closing the browser, others are persistent and enable User recognition on subsequent visits.

3. The User can manage cookies through browser settings; blocking or deleting cookies may affect full use of the Service.

4. Detailed information regarding personal data processing and categories of cookies, as well as methods of managing preferences, is available in the Privacy Policy and Cookies Policy available on the Service.

XI. Liability and Service Availability

1. The Service Provider makes due diligence efforts to ensure the Service operates continuously and securely; however, temporary or long-term unavailability may occur due to reasons beyond the Service Provider's control or due to technical work.

2. Information published on the Service is general and informational in nature and does not constitute professional advice. The User uses the Service at their own risk.

3. The provisions of this section do not exclude or limit the rights of the Consumer resulting from mandatory applicable law.

4. External Links - Links to other websites placed on the Service are informational in nature. The Service Provider is not responsible for content on those websites or consequences of their use.
